BPOs cannot avail cheap power

From next month, the electricity department will impose sanctions to subcontractors that have not adapted their gas connections of the industrial category to the category of non-nationals. Energy distribution association Dakshin Haryana Bijli Vitran Nigam (DHBVN) has set a deadline of April 30, Al l BPO (Business Process Outsourcing) companies to voluntarily convert such a connections and pay the consumption rate as the loan rate fixed for non-domestic users.

DHBVN officials stated the department has been costing revenue as the rate per unit energy consumption in the industrial category is less as opposed to the commercial grades.

Gurgaon BPO has about 250 small, medium and large that were previously classified as industrial.

The consumption rate per unit of electricity in the industrial category is Rs 4. 28 additonally commercial consumers are charged at a rate of 4.68 rupees per unit.

Some BPO (also famed as guidelines technology enabled services (ITES) units) still have electricity connections in the industrial category, a DHBVN spokesman said here on Wednesday.

The spokesman said, according to the industrial and Investment Policy 2011 of Government of Haryana, non-domestic rate applies in the case of ITES units reported by the government.

Consequently, consumers are responsible for punishment.

However, the department had made an selection for consumers to get the connection status has changed to April 30 giving program for change of status in the respective offices DHBVN.

In accordance with the procedure, the consumer must submit a new application and agreement form duly wound up along in on customer safety, handling fee at current rates and the revised test report.

APAC IT services to hit US$53B in 2011

IT services spending in the Asia-Pacific region, excluding Japan, is expected to achieve a year with a growth of 8.7 percent in 2010 as more organizations turn to outsourcing and embarking on new IT projects revealed a new study.

Q&A: Why Hulcher picked Brazil over India for IT

Did the offshore outsourcing in general, for a long time now and where?

We had been outsourcing to India for about six years. They were not particularly happy with the situation. Hourly rates are excellent, but we have experienced high turnover and the difficulty we experience in direct collaboration with the developers got a big part of valor.

What are the main issues that can be achieved that make life more difficult when outsourcing?

There is nothing better than having the group you need in the room. Email, phone, video conferencing, collaboration software ... are all attempts to mitigate the possibility of the presence of all. We have all the tools, and each situation improves, but not collectively as opposed to having them all in one place.

We also have no control over the company that the contractor actually works for us - we can create both a more positive work environment possible, but if you do not have that same work environment in the company that hired them, we will see a higher turnover and burnout.

You have a contract with the Brazilian company Stefanini IT Solutions for Agile software development and testing needs. What helped you choose a business partner?

The first time I came into contact with Stefanini several years ago when I was initially nearshore research model. I initiated this meeting. I met in Sao Paulo through Brasscom event that the Brazilian companies seeking outsourcing partners with Brazilian organizations.

I was very impressed with his team and the fact they were very strong in the pursuit of agile development methods, and were actively working on medium-sized enterprises. There were other companies I looked in Brazil, but Stefanini was the leading candidate in the negotiations leading prices.

Did you ever consider doing it yourself - just open a branch office in Brazil with his own team?

By gusts of about 10 seconds, then I shudder at the logistics and not think about it again. There are numerous employment laws in Brazil (as elsewhere), and the concept of dealing with them is overwhelming.

The only way that I honestly consider a remote office is if my company has a strong presence in Brazil. Still, I would like very likely to outsource.

Do you see Brazil as a potential market for his company and a provider of IT services? If so, does that make work more attractive to Brazil in IT so build a relationship with the country?

My company is mainly in the rail industry and disasters, and environmental remediation. Brazil is heavily dependent on the trains and have no doubt his participation in man-made disasters and natural.

I think [Brazil] is an excellent market for my company, but only to monitor the technology. That decision is, as they say, above my pay grade.

President Obama promised to crack down on businesses that use outsourcing, but the tax system. Does any campaign promises come true?

Not at all.

What do you see as the main advantages and disadvantages of his team in Brazil, especially in comparison with an offshore team different?

The model is completely different nearshore outsourcing to India. The central zone is similar to dynamically schedule the meetings and discuss issues on an ad hoc basis. Because the areas of time align so closely, I have the same level of confidence that can be connected to someone in Brazil that I have in my ability to connect with someone in my building.

People in business, ranging from the product owner accountants systems administrators know the people on the team in Brazil. The team is on our phone system is linked to our video conferencing system, so I see every day the team members. This never happened with India.

On the negative side, I believe that supply individual developers speak English was more difficult in Brazil. English is a second language, optional in Brazil and nearly as common as it is in India. Thus, staffing teams was considerably more difficult in Brazil, but not prohibitive.

If you were to advise the industry in Brazil on how to paint a better picture of U.S. companies, what would you say?


In fact, I wrote an article on this topic to InformationWeek, last year. The highlights are that Brazil needs to pursue those industries where there are similarities in the ascendancy, and push hard agile development methods.

São Paulo is the largest financial center in South America, and most of our developers with experience in financial firms. Petrobras is one of the largest oil companies in the world. There are numerous industries in which Brazil has a strong national experience, and may use this in international outsourcing.

The other is the nearshore model. Due to cultural similarities and similar areas in time, Brazil is a great way to give a sense of personal gain rather than development offshore.

As we have daily meetings actually see more of our members of the Brazilian team that I most people in my corporate office. The close integration of the teams that really leads to a better product, and Brazil should push for this axiom.

What was your impression of the mission this year is Carnival organized by Apex Brasil, that you attended?

Carnival was amazing, Apex organized an excellent event. Is first class in everything. I was surprised how small carnival was safe. Yes, they have some of the elaborate costumes that are somewhat revealing, but there are so lewd.

Dollar Weakens:Brent crude climbs to $122 as equities rally

As per the PPA agreement, the first unit was to be anticipated by May 2013. According to the company, the six houses of 660 MW each might be commissioned by June 2014.

New Delhi: India's fourth largest IT software and services exporter HCL Technologies has reported 16.5% growth in its third quarter net income of $103.5 million as against $89 million in previous quarter.

Revenues went up by 5.8% to USD 914.5 million in third quarter of FY11 based on USD 864 million observed in previous quarter. Earning before interest, tax, depreciation and amortisation (EBITDA) stood at USD 158.4 million for the same quarter.

Discussing this entrance exam, Daniel Mathew, assistant professor of Law at the West Bengal National University of Juridical Sciences mentions, "There is no magic formula to ace the entrance as this is mainly an aptitude test. A student's ability to read and comprehend English, their current awareness, logical reasoning and legal aptitude are being tested. No background knowledge of law is required for this exam".

Corruption laws in India
Public servants in India can be penalized for corruption under the Indian Penal Code, 1860 and the Prevention of Corruption Act, 1988. The Benami Transactions (Prohibition) Act, 1988 prohibits benami transactions. The Prevention of Money Laundering Act, 2002 penalises public servants for the offence of money laundering. India is also a signatory (not ratified) to the UN Convention against Corruption since 2005. The Convention covers a wide range of acts of corruption and also proposes certain preventive policies.

Key Features of the Acts related to corruption
Indian Penal Code, 1860:

The IPC defines “public servant” as a government employee, officers in the military,
navy or air force; police, judges, officers of Court of Justice, and any local authority
established by a central or state Act.
• Section 169 pertains to a public servant unlawfully buying or bidding for property. The
public servant shall be punished with imprisonment of upto two years or with fine or
both. If the property is purchased, it shall be confiscated.
• Section 409 pertains to criminal breach of trust by a public servant. The public servant
shall be punished with life imprisonment or with imprisonment of upto 10 years and a
fine.

The Prevention of Corruption Act, 1988
• In addition to the categories included in the IPC, the definition of “public servant”
includes office bearers of cooperative societies receiving financial aid from the
government, employees of universities, Public Service Commission and banks.
• If a public servant takes gratification other than his legal remuneration in respect of an
official act or to influence public servants is liable to minimum punishment of six months
and maximum punishment of five years and fine. The Act also penalizes a public servant
for taking gratification to influence the public by illegal means and for exercising his
personal influence with a public servant.
• If a public servant accepts a valuable thing without paying for it or paying inadequately
from a person with whom he is involved in a business transaction in his official capacity,
he shall be penalized with minimum punishment of six months and maximum
punishment of five years and fine.
• It is necessary to obtain prior sanction from the central or state government in order to
prosecute a public servant.

The Benami Transactions (Prohibition) Act, 1988
• The Act prohibits any benami transaction (purchase of property in false name of another
person who does not pay for the property) except when a person purchases property in his
wife’s or unmarried daughter’s name.
• Any person who enters into a benami transaction shall be punishable with imprisonment
of upto three years and/or a fine.
• All properties that are held to be benami can be acquired by a prescribed authority and no
money shall be paid for such acquisition.

The Prevention of Money Laundering Act, 2002
• The Act states that an offence of money laundering has been committed if a person is a
party to any process connected with the proceeds of crime and projects such proceeds as
untainted property. “Proceeds of crime” means any property obtained by a person as a
result of criminal activity related to certain offences listed in the schedule to the Act. A
person can be charged with the offence of money laundering only if he has been charged
with committing a scheduled offence.
• The penalty for committing the offence of money laundering is rigorous imprisonment
for three to seven years and a fine of upto Rs 5 lakh. If a person is convicted of an
offence under the Narcotics Drugs and Psychotropic Substances Act, 1985 the term of
imprisonment can extend upto 10 years.
• The Adjudicating Authority, appointed by the central government, shall decide whether
any of the property attached or seized is involved in money laundering. An Appellate
Tribunal shall hear appeals against the orders of the Adjudicating Authority and any other
authority under the Act.
• Every banking company, financial institution and intermediary shall maintain a record of
all transactions of a specified nature and value, and verify and maintain records of all its
customers, and furnish such information to the specified authorities.

Process followed to investigate and prosecute corrupt public servants

• The three main authorities involved in inquiring, investigating and prosecuting corruption
cases are the Central Vigilance Commission (CVC), the Central Bureau of Investigation
(CBI) and the state Anti-Corruption Bureau (ACB). Cases related to money laundering
by public servants are investigated and prosecuted by the Directorate of Enforcement and
the Financial Intelligence Unit, which are under the Ministry of Finance.
• The CBI and state ACBs investigate cases related to corruption under the Prevention of
Corruption Act, 1988 and the Indian Penal Code, 1860. The CBI’s jurisdiction is the
central government and Union Territories while the state ACBs investigates cases within
the states. States can refer cases to the CBI.
• The CVC is a statutory body that supervises corruption cases in government departments.
The CBI is under its supervision. The CVC can refer cases either to the Central
Vigilance Officer (CVO) in each department or to the CBI. The CVC or the CVO
recommends the action to be taken against a public servant but the decision to take any
disciplinary action against a civil servant rests on the department authority.
• Prosecution can be initiated by an investigating agency only after it has the prior sanction
of the central or state government. Government appointed prosecutors undertake the
prosecution proceeding in the courts.
• All cases under the Prevention of Corruption Act, 1988 are tried by Special Judges who
are appointed by the central or state government.

Tata Sons files defamation case against Outlook magazine

Tata Sons Ltd has filed a criminal defamation complaint against news magazine ''Outlook'' for publishing articles which had claimed that the group received "undue pecuniary advantage" from former Disinvestment Minister Arun Shourie during divestment of state-owned VSNL in 2002.

In a criminal complaint filed before the court of Additional Chief Metropolitan Magistrate, Mumbai, Tata Sons has claimed that an article published by ''Outlook'' in its March 28, 2011 edition and another in the April 4, 2011 edition made "false and defamatory statements and harmed the reputation of the Tata business name".

According to the complaint, the article published by ''Outlook'' in its March 28 edition titled "Arun Shourie''s Gift to Tatas" suggests that the Tatas "received undue pecuniary advantage" from Arun Shourie in his capacity as Minister of Disinvestment in relation to the group''s acquisition bid for 25 per cent stake in VSNL when it was privatised by the Centre in 2002.

It further said another article published in April 4, 2011 edition titled "A Land of No Return" also related to the disinvestment of VSNL "levelled certain additional allegations without any basis".

Tata Sons claimed that no attempt was made by the magazine to contact Tatas to seek clarifications before publishing the articles.

"The defamatory article is clearly and deliberately motivated...The allegations, insinuations, innuendos contended therein are concocted, false and not verified," it said.

When contacted, Outlook Editor-In-Chief, Vinod Mehta said the magazine has not yet received any notice on the complaint and would not be able to comment on the matter.

Apart from Mehta, Tata Sons'' had also named Outlook printer and publisher Maheshwari Peri, and Author and Assistant Editor Saikat Datta in the complaint.

In its complaint Tata Sons urged the court to "issue process against the accused" and they should be "tried according to law".

Tata Chemicals acquires 25.1pc stake in urea complex in Africa

Tata Chemicals today said it has acquired 25.1 per cent stake in the ammonia-urea fertiliser complex at Gabon in Africa for USD 290 million (nearly Rs 1,300 crore).

In a filing to the Bombay Stock Exchange, the company believed it has "executed binding agreements to acquire 25.1 per cent stake for USD 290 million as a strategic investor in stream 1 of a greenfield port-based ammonia-urea fertiliser manufacturing complex in the Republic of Gabon, Africa."

Other shareholders in the imagine are Olam with 62.9 per cent stake and the Gabon government with 12 per cent stake, the filing added.

Chandrayaan-2 to cost Rs 426 crore

Chennai, Apr 9 (PTI) ISRO will spend Rs 426 crore for the country''s second unmanned moon target -- Chandrayaan-2, a senior scientist of the space agency said here today.

This is an additional Rs 40 crore for Rs 386 crore spent earlier on the first mission, Project Director Mylswamy Annadurai told reporters right here on the sidelines of a function.

Chandrayaan-2, that is expected to be launched in September 2013, is a lunar landing mission, while the earlier one (Chandrayaan-1) was only an orbiter, Annadurai said.

ISRO had terminated Chandrayaan-1 odyssey on August 30 2009, a year after it was launched in October, after it failed to re-establish contact, lost the previous day, with the lunar craft.

The second mission, which would have an orbiter, a lander and a rover, is implemented to be launched onboard Geosynchronous Satellite Launch Vehicle from Satish Dhawan Space Centre, Sriharikota.

ICC lifts ban on news channels' coverage of World Cup final

New Delhi, April 1 (IANS) International Cricket Council (ICC) has lifted the ban on the electronic media's insurance of Saturday's World Cup final with a rider: Any infringement will lead to initiation of legal proceedings.

'Despite a lengthy meeting at the Ministry of Information and Broadcasting in New Delhi, the National Broadcasters Association (NBA) and the Broadcast Editors Association (BEA) refused to give assurances that they would desist from breaching the broadcast tips in their news programming,' ICC claimed in a statement.

Accordingly, the ICC has resolved to commence legal action against the businesses involved and will also seek to recover damages through the courts in India rather than bar the channels from the ICC Cricket World Cup final.

ICC chief executive Haroon Lorgat said that ICC will 'take all steps crucial to cover our commercial rights.'

'I am very disappointed that it has come to this, however, we need to do everything to cover our exclusive commercial rights and folks of our partners. If too means we have to resort to legal action, that is regrettable but necessary,' he said.

The ICC claimed Indian news channels have repeatedly breached the news access guidelines for broadcasters in the World Cup.

'At the Ministry's request, we travelled to New Delhi to meet with the NBA and BEA in an administered to reach the conclusion the issue but properties were unfortunately not keen to conform to the guidelines agreed with the ICC prior to the event.'
